1) In General

This website (the “Website”) is owned and operated by Aspira Marketing LLC (“Aspira,” “we,” “us,” or “our”). These Terms & Conditions (the “Terms of Service” or “Terms”) govern your access to and use of the Website and any products, services, features, or content made available through it (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. We may update these Terms from time to time by posting a revised version on this page, and your continued use of the Services after any changes constitutes acceptance of those changes. Access to the Website is permitted on a temporary basis, and we reserve the right to withdraw, suspend, or amend the Services without notice. We will not be liable if the Website is unavailable at any time or for any period. We may restrict access to some or all parts of the Website from time to time.

The Website may contain links to third-party websites (the “Linked Sites”). Aspira has no control over Linked Sites and is not responsible for their content, policies, or any loss or damage that may arise from your use of them. Your use of Linked Sites is subject to the terms and policies applicable to those sites.

3) Prohibited Conduct

You must not misuse the Website. You agree not to: (a) commit or encourage a criminal offense; (b) transmit or distribute viruses, worms, Trojans, logic bombs, or other malicious or technologically harmful material; (c) attempt to gain unauthorized access to the Website, the server on which it is stored, or any server, computer, or database connected to the Website; (d) attack the Website via a denial-of-service attack or a distributed denial-of-service attack; (e) corrupt data, scrape or crawl the Website without permission, or interfere with performance or functionality; (f) infringe any intellectual property or privacy rights; (g) send unsolicited advertising or promotional material (“spam”); or (h) upload or post any offensive, obscene, or unlawful content.

Breaches may constitute criminal offenses. We may report any breach to relevant law enforcement authorities and disclose your identity. We are not liable for any loss or damage caused by distributed denial-of-service attacks, viruses, or other harmful material that may infect your computer equipment, programs, data, or other proprietary material due to your use of the Website or any Linked Sites.

All such rights are reserved.

You may store, print, and display Website content solely for your personal, non-commercial use. You may not publish, manipulate, distribute, reproduce, create derivative works from, sell, or exploit any content (in whole or in part) for any commercial purpose without our prior written consent.

5) Online Store; Terms of Sale

Eligibility. By placing an order, you represent that you are at least the age of majority in your state/province/country of residence and are legally capable of entering into binding contracts. You also represent that you are an authorized user of the payment method used and that sufficient funds/credit are available.

Orders & Acceptance. Your order is an offer to purchase products under these Terms. After placing an order, you may receive an acknowledgment email confirming we received it; this acknowledgment does not constitute acceptance. A binding contract is formed only when we send you a dispatch/shipping confirmation email. The contract applies only to the items listed in that email.

Availability & Errors. All orders are subject to availability. We try to ensure that details, descriptions, and prices are accurate; however, errors may occur. If we discover an error in pricing or product information for an order you placed, we will notify you and give you the option to reconfirm at the correct details or cancel for a full refund. If we cannot reach you, we may treat the order as canceled.

Prices; Taxes; Shipping. Prices are subject to change without notice. Applicable taxes and shipping costs will be added at checkout and shown in the order total. The cost of foreign products and services may fluctuate due to exchange rates and other factors.

Payment Authorization. Upon receiving your order, we may run a standard authorization on your payment method to ensure funds are available. Your card or payment method may be charged upon authorization. Amounts charged prior to dispatch are treated as a deposit and applied to the purchase price when your order ships.

Right to Refuse or Limit. We reserve the right to refuse any order; limit or cancel quantities purchased per person, household, or order; and restrict orders placed under the same account, payment method, or shipping/billing address. If we modify or cancel an order, we will attempt to notify you using the contact information provided.

6) Accuracy of Information

Information on the Website is provided for general information only and may not be accurate, complete, or current. It should not be used as the sole basis for decisions without consulting more precise, complete, or timely sources. Any reliance on Website material is at your own risk. We may update content at any time but have no obligation to do so unless required by law.

Certain products or Services may be available exclusively online and in limited quantities. All product descriptions and pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time and to limit the sale of products or Services to any person, geographic region, or jurisdiction on a case-by-case basis. We make reasonable efforts to display product colors and images accurately, but we cannot guarantee that your device’s display of any color will be accurate. We do not warrant that products, Services, information, or other material purchased or obtained will meet your expectations or that errors in the Services will be corrected.

9) Billing & Account Information

You agree to provide current, complete, and accurate purchase and account information for all purchases and to promptly update your account (including email, addresses, and payment details) so we can complete your transactions and contact you as needed.

10) Optional Tools & Third-Party Links

We may provide access to third-party tools “as is” and “as available,” without warranties or endorsement and without liability for your use. The Website may contain links to or materials from third parties. We are not responsible for examining or evaluating third-party content and will have no liability for any third-party materials, sites, products, or services. Review third-party terms and policies carefully before engaging in any transaction or use.

11) User Content; Feedback

If you submit or post ideas, suggestions, proposals, plans, reviews, or other materials (collectively, “Comments”), you grant Aspira a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such Comments in any media. We have no obligation to (a) maintain any Comments in confidence; (b) pay compensation for any Comments; or (c) respond to any Comments. You represent that your Comments do not infringe any rights of any third party and will not contain unlawful, abusive, defamatory, obscene, or otherwise objectionable material, or malware. You are solely responsible for your Comments.

12) Errors, Inaccuracies & Omissions

Occasionally, there may be information on the Website or in the Services that contains typographical errors, inaccuracies, or omissions (including relating to product descriptions, pricing, promotions, shipping charges, transit times, and availability). We reserve the right to correct such issues and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you submit your order), except as limited by applicable law.

13) Prohibited Uses (Additional)

In addition to Section 3, you are prohibited from using the Website or its content to: (a) violate any applicable law or regulation; (b) infringe our or others’ intellectual property; (c) harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate; (d) submit false or misleading information; (e) collect or track others’ personal information without consent; (f) spam, phish, pharm, pretext, spider, crawl, or scrape; (g) upload or transmit malicious code; (h) interfere with security features; or (i) engage in any obscene or immoral purpose. To the fullest extent permitted by law, Aspira, its directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, and licensors will not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, revenue, savings, data, replacement costs, or similar damages, arising from or related to your use of the Services or any products procured using the Services, or any other claim related in any way to your use of the Services or any product, including errors or omissions in any content, or any loss or damage of any kind incurred as a result of use of the Services or content posted, transmitted, or otherwise made available. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such jurisdictions our liability shall be limited to the maximum extent permitted by law. Nothing in these Terms limits or excludes liability that cannot be limited or excluded by applicable law (including for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation).

15) Indemnity

You agree to indemnify, defend, and hold harmless Aspira and its directors, officers, employees, contractors, agents, suppliers, licensors, service providers, and affiliates from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms, your violation of any law or third-party rights, or your use of the Services.

16) Changes (Variation)

We may, in our sole discretion and without notice, amend, remove, or vary the Services and/or any page of the Website.

17) Severability; No Waiver

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed without affecting the validity or enforceability of the remaining provisions. If you breach these Terms and we take no action, we may still exercise our rights and remedies in any other situation where you breach these Terms.

18) Orders, Shipping & Tracking

Order Confirmation. After you place an order, you will receive a Purchase Confirmation email with your order number and details.

Same-Day Changes/Cancellations. You may cancel your order or request changes to your shipping information until 11:59 PM (local time) on the day the order is placed. After that time, we begin processing.

Processing Time. Typical processing is 1–3 business days (excluding weekends/holidays). When your order ships, you will receive a Shipping Confirmation email.

Tracking. You will receive a Shipping Update with tracking details when available. Tracking data may take 24–72 hours to update and occasional gaps between scans are normal.

19) Delivery Timeframes

Orders shipping from the UK or US: Estimated delivery 2–6 business days from the shipping date.
Orders shipping outside the UK or US: Estimated delivery 6–14 business days from the shipping date.

Delivery timelines are estimates and may vary due to carrier delays, customs, weather, or other factors outside our control.

20) Returns & Exchanges

Cancellation Policy. You may cancel your order until 11:59 PM (local time) on the purchase date for a full refund. If your order has already shipped (you received a Shipping Confirmation), we are unable to cancel.

Damaged/Defective Items Only. If your product arrives damaged or defective, please email contact@aspira-breath.com within 15 days of delivery with the subject line:
“Return: Damaged/Defective – Order #[your order number]” and include clear photos of the issue and packaging. Upon approval, we will provide next steps for a replacement or refund at our discretion.

Condition Limits. The return policy applies only to items with manufacturing defects or damage in transit. We do not accept returns or issue refunds for used items or buyer’s remorse once a product is delivered in normal condition.

Shipping Costs. Original shipping charges are non-refundable. Unless otherwise required by law or expressly stated by us in writing, the buyer is responsible for return shipping (with tracking).

21) Entire Agreement

These Terms constitute the entire agreement between you and Aspira regarding the Services and supersede all prior or contemporaneous communications and proposals (whether oral or written). Any waiver of any provision of these Terms is effective only if in writing and signed by a duly authorized representative of Aspira.
